Terms & Conditions

Heyo! Get ready for the boring but necessary shit that is the Terms and Conditions. I’ll not only layout here how not to be an asshole but also what you can expect if we are working together on a custom project, how we’ll be communicating when you hire me, and …. So, here we go… Sarah M. Holm, LLC (me, my, I) reserves the rights to abso-fucking-lutely everything on this website.

YOU AGREE THAT, BY USING THIS SITE AND/OR SERVICES PROVIDED BY THE SITE, PURCHASING WORK FROM THIS SITE, POSTING ANY CONTENT TO THIS SITE, YOU HAVE READ AND AGREE TO BE BOUND BY ALL THE TERMS LISTED ON THE SITE. IF YOU DON’T AGREE, YOU HAVE NO RIGHT TO USE THIS SITE.

  1. Don’t be an asshole. All of the art, designs, and words on this website are the property of Sarah M. Holm. Don’t copy my stuff or ideas and pawn them off as your own. Just don’t.

  2. Social Sharing. Ok, you want to share my stuff with the world… I’m blushing. Follow these rules to share any pictures from my website.

    1. Post one picture of the finished product.

    2. Link back to my website where you found the image or social media handle associated with where you are posting the image:

  3. Shop Policies. The shop is comprised of items that are either Ready-made or Made to Order. See below for the policies on each category.

    1. Ready-made Items:

      1. Ready-made items are defined as the goods in my shop that are available for purchase immediately and are not labeled as “Made to Order”, “Custom” or “Made to your Measurements”.

      2. All ready-made items are made by hand or prints of works of art that were originally made by hand, therefore they may have tiny “flaws”. You are agreeing to seeing these “flaws” as evidence to the handmade character of the piece and not as a reason to make a fuss.

      3. If ordering only ready-made items, they will be shipped on the nearest shipping day (see Shipping for more information).

      4. If ordering ready-made items with made-to-order or custom items, ready-made items will be shipped when the other items are ready, so everything is shipped together.

      5. Ready-made items can be returned for a full refund minus shipping as long as they arrive in the same condition as originally sent and with the original packaging. For more information on this, see Returns.

    2. Made to Order Items.

      1. Made to Order items are defined as items available in the web shop that I make after you purchase them from the website. These will be labeled: “Made to Order” or “Hand-made to your measurements”.

      2. All belts that are not currently in stock are Made to Order.

      3. Any item that requires you to fill out a measurement form is a Made to Order item.

      4. Made to Order items will be created during the time span denoted in the item description (usually 2 or 3-4 weeks). This time span does not include shipping. Shipping will vary according to your chosen shipping method and will be added onto the quoted creation time.

      5. If you are not pleased with your Made to Order item, it can be exchanged or returned minus shipping and applicable fees if received in original condition with original packaging, following these guidelines:

        • Exchange: Made to Order items can be exchanged for the full monetary value (minus shipping) in ready-made only items on the website.

        • Belt Exchange: Made to Order belts can be exchanged for the same style belt in another size. If the new size is not in stock (ready-made), the originally quoted creation time is applied to the new belt.

        • Returns: Made to Order items (except for clothing items, see below) can be returned for the original price, minus shipping and minus a 20% restocking fee.

        • Clothing Returns: Made to Order clothing can be returned for a refund of the original price minus shipping and a 50% restocking fee. Clothing that is made to your measurements is difficult/sometimes impossible to resell, so I must sell it at a highly discounted rate. MAKE SURE TO BE ACCURATE WHEN TAKING MEASUREMENTS!

  4. Custom Work Policies.

    1. A custom item is defined as an item that is designed and created specifically for the customer. These items are not available in the web shop and must be ordered through filling out the online form on the Custom Work Page.

    2. I reserve the right to reject a custom order. There are many reasons that I may do this, including, but not limited to, it being beyond my scope of ability or interest or not having enough time in my schedule. I reserve the right to reject a project without giving a reason.

    3. If the Custom Work Page states that I am not taking custom work right now, it means just that. Do not send custom work inquiries through other avenues. I will announce on the Custom Work Page and on Instagram when my books are open to custom work again.

    4. Custom orders will be proceed as follows;

      1. After reading these policies and filling out the form on the Custom Work Page, I will respond to the client within 7 days via email to:

        • Set up an appointment to for an initial meeting in person (or Facetime or Skype if applicable). The appointment will be held by putting down a $30 meeting deposit. This non-refundable fee will be put towards your project.

        • or reject the project. If I can’t do it, I won’t leave you hanging.

      2. The initial meeting is to make sure that we are really on the same page and really understand the scope of the project. If we are able to meet in person, I will also take any necessary measurements at this time. Please have prepared for the meeting:

        • Pictures of inspiration: This could include images that evoke the mood, images of designs that are similar to what you are looking for, photos of people/pets (for custom portraits).

        • Approximate size of the piece.

        • Your Budget

        • The Date that this item is needed by.

      3. After the initial meeting, if your project is accepted, I will send you an estimate email within 2 weeks with a rough sketch of the design and the cost estimate. At this point, I will need a 50% deposit to start the project. I will not commence work on the project until this deposit has been made.

        • If I have not received the deposit 14 days, the project will be put on hold and moved to the back of the line of projects in the works.

        • After 14 days, in addition to the 50% deposit, the client will be charged and additional 2% service fee, compounded daily.

        • If I have not received the deposit/fees within 30 days, the project is considered cancelled and you will have to start the process over if you’d like to hire me at a future date. I retain the full rights of any and all intellectual property, including but not limited to the sketch and ideas I shared at our meeting.

      4. After receiving the deposit, I will create a project timeline as well as a shared Google Document that will act as a project summary & timeline, contract, and communication board for our project. All questions and additional ideas must be posted on the Google Doc. I will check the document weekly and respond to any questions or concerns there.

      5. Each Timeline will vary depending on the project and some may require extra meetings. This will all be laid out in the Google Document.

        • Most Clothing and Complex Leather Wearables (like full-body harnesses) will have 2 fittings, one in the middle of the project to make sure everything is fitting well and one final fitting to see if any minor adjustments must be made.

        • Custom art will have no additional meetings.

      6. Projects are considered finished when they meet the terms of the original estimate. Any additional work or change in scope will need to be submitted and accepted in writing (on the Google Doc) and will be billed at the hourly rate of $50.

      7. When the project is finished, I will email you an invoice for the remaining cost of the project. We will then arrange for project pick up or shipping. The remainder of the price will be due at pick up or prior to shipping.

        • With Clothing and Complex Leather Wearables, the final fitting is considered “pick-up” and the remaining balance is due. If any minor adjustments must be made, they will be billed at the hourly rate, which would be due prior to or at the next scheduled pick up.

      8. Cancellation Policy. If a Custom Project needs to be cancelled, I understand. Life sometimes interrupts our plans. There will be charges for the time put into the project though, ie kill fees. If a project is cancelled…

        • Prior to initial meeting = no charge, the $30 deposit can converted to credit in my web shop.

        • After the initial meeting, but before the deposit = no charge, but I’m keeping the $30

        • After the deposit, during Stage 1 (before first fitting) of project as laid out in the timeline = 20% kill fee will be taken from the deposit before returning the rest.

        • After the deposit, during Stage 2 (after first fitting) of project as laid out in the timeline = 30% kill fee will be taken from deposit before returning the rest.

      9. Communication Policy.

        • All Custom Work begins by filling out the form on the Custom Work Page.

        • I will respond to the form via email.

        • Unless otherwise stated in the first email, will meet up for 1 initial 30 minute meeting in person or by Facetime/Skype.

        • After the initial meeting, communication will continue through a Google Doc. All questions, ideas, additions to the project will be written on the Google Doc.

        • I will send all invoices and schedule fittings via email. Responses to scheduling inquiries can be sent via email. All other communication about the project will take place on the Google Doc.
